MDIGGER® PRIVACY POLICY

mDigger, Inc., the owner and operator of mDigger Service, is committed to protecting your privacy. We have posted this privacy policy to help you understand how personally identifiable information that you submit and non-personally identifiable information that mDigger, Inc. may collect as a result of your usage of the mDigger Service, will be treated. In this policy, we are referring to the mDigger websites (www.mdigger.com).

Personally Identifiable Information: Collection & Use

Personally identifiable information can only be collected when you provide it. You are not required to provide personal information in order to use the mDigger website. You may use several areas of our Site or browse the Site without registering on the Site.

However, in order to use the full functionality of mDigger Service you must register with our Site and create a login name and password. Currently the only personally identifiable information about you that mDigger, Inc. collects during the registration process is your mobile telephone number or email address. We use this information in order to contact you with notices about software and service updates, changes to license agreements or service terms of use, as well as to inform you about new products and services we offer.

We do not rent or sell your personally identifiable information to third parties.

Non-Personally Identifiable Information Collection & Use

We collect non-personally identifiable information automatically in the instances and for the reasons indicated below.

  1. When you use mDigger software on your mobile device or computer, it includes a unique identifying number so that we provide a personalized experience to your device or computer.
  2. "Cookies" are small files placed on your hard drive that allow websites to identify you. The use of cookies is a common practice on many websites. For example, if you allow a site to remember your login name or password, the site places a cookie on your computer. Cookies cannot read any other information on your hard drive. We may place cookies on your computer to allow us to identify you. We may use cookies to measure website traffic, to offer you certain services, or to customize your visit. We use cookies to improve the quality of our service by storing user preferences and tracking user trends. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features and services may not function properly if your cookies are disabled.
  3. An "IP address" is a number that is automatically assigned to your mobile device when you use the Internet. In some cases your IP address stays the same from browser session to browser session; but if you use a consumer internet access provider, your IP address probably varies from session to session. mDigger, Inc. automatically receives and records information on our server logs from your browser, including your IP address, the date and time of your query, browser type, cookie information, and the page you request. We use this information to operate, develop and improve our services.
  4. Log Files: As is true of most websites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and click stream data. We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users' movements around the Site and to gather demographic information about our user base as a whole.
  5. mDigger, Inc. receives information about your mobile device when you access the service from your mobile device. This is non-personally identifiable information that we use to help us identify your phone, and information about your phone such as screen dimensions, the kind of media formats supported by your phone, and memory available for use. We use this information to improve our service and support tailoring the service to the devices you use.

We do not link this automatically-collected and non-personally identifiable data to personally identifiable information.

Security

mDigger, Inc. endeavors to protect the security of your personal information and your choices for its intended use. We store your account information on a secure server, and use procedures designed to protect the personal information we collect from loss, misuse, unauthorized access or disclosure, alteration or destruction.

Although we will take commercially reasonable security precautions regarding your personal information collected from and stored on the Site, due to the open nature of the Internet, we cannot guarantee that any of your personal information stored on our servers, or transmitted to or from a user, will be free from unauthorized access, and we disclaim any liability for any theft or loss of, unauthorized access or damage to, or interception of any data or communications. By using the Site, you acknowledge that you understand and agree to assume these risks.

Email is not recognized as a secure medium of communication. For this reason, we request that you do not send any personal information to us by email. However, doing so is allowed, but at your own risk. We follow commercially reasonable security precautions to protect the personal information submitted to us, both during the transmission and once we receive it.

Public Forums

Our website offers developer forums. If you use a forum on this Site, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. Thus information posted in these forums will be publicly available. We are not responsible for the personally identifiable information you choose to submit in these forums.

Surveys

From time to time we may provide you the opportunity to participate in surveys on our Site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code). Requested information may include a combination of personally identifiable information (such as a name or e-mail address), and demographic information (such as zip code or age).

We use personally identifiable information obtained from surveys for the express purpose stated at the time of submission of the survey, and if no express purpose is stated, then for the implied purpose of the request, and otherwise in accordance with this Privacy Statement. For example, we would use an e-mail address to communicate requested product information. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior notice and choice.

Unless otherwise noted, demographic information received in response to a survey, including any opinions expressed, will be used and analyzed internally and may be disclosed to third parties, however, any information/responses disclosed will be demographic in nature and will not be attributed to any specific user.

mClip Privacy/Links to Third Party Websites

mDigger Service lets you select mClips from our catalog and add them to your personal mDigger space for viewing information from their original sources in an improved format that lends itself to easy presentation on your device or computer. mClips select information from original Internet sources and transform its format. Please note that mDigger, Inc. is not the provider or owner of any the informational content you view within the mClips, unless otherwise stated. Instead, our mClips merely provide you with the means to access a variety of content, applications, and services offered by third party content providers. This Privacy Policy does not apply to any information that may be collected by or that you submit to third party content providers as you interact with them for various reasons (for instance, to make a purchase) via our mClips.

Under certain conditions, mDigger Service makes it possible for third parties ("third-party publishers") to publish mClips. mClips created by third party publishers may provide you with the means to access a variety of content, applications, and services offered by these third party publishers or their affiliates. By signing up for and receiving their mClips you exchange information with these third party publishers and/or their affiliates. Please be aware that this Privacy Policy does not govern any exchange of information between you and any third party publisher.

mDigger, Inc. does not monitor, and is not responsible for, the privacy and data use policies of its content providers or third party publishers. We recommend you review their policies (likely to be found on their websites) prior to accessing their information, but especially before sharing any personally identifiable information.

Similarly, this Privacy Policy does not govern the privacy practices of any third party website to which you might link from the mDigger website. While mDigger, Inc. does not knowingly collect or use personally identifiable information exchanged between you and any content provider, we may track general use data, such as the sequence in which you view portions of an mClip (sometimes called "click-streams") and other non-personal information. This information is used to improve the Service and may also be shared with content providers or third-party publishers to help them improve their content and services.

Our site may link to other sites not controlled by mDigger, Inc. We are not responsible for the privacy or security practices of any other websites. We therefore encourage you to read the privacy policies of those other sites.

Acceptance of this Privacy Policy

By using this Site, you signify your acceptance of our Privacy Policy. If you do not agree to this Privacy Policy, please do not use our Site or our Service. As we update and add additional services, this Privacy Policy may evolve. We reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time so visitors are encouraged to review this Privacy Policy from time to time. Please check this page for updates periodically. We will also try to post any changes to this Privacy Policy before they become effective. Your continued use of our Site following the posting of changes to these terms means you accept these changes.
